Terms of Service — Faceshion

1. Acceptance of Terms

By accessing or using the Faceshion platform, website, embedded widget, or any related services (collectively, the “Service”) operated by Faceshion (“we”, “our”, “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. The Service

Faceshion provides an AI-powered virtual try-on tool that allows online shoppers to preview clothing, accessories, and other fashion items on their own image. Merchants integrate the Service into their e-commerce stores via a JavaScript embed snippet or API.

3. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a merchant account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Plans, Credits & Billing

Faceshion is offered under credit-based plans (Starter, Growth, Scale, Enterprise). Each plan includes a defined number of try-on credits. Unused credits do not roll over between billing periods unless explicitly stated. Prices are listed in USD and exclude applicable taxes. Paid plans renew automatically unless cancelled before the next billing cycle. All payments are processed by our authorized payment partners.

4a. Merchant of Record

Online payments for Faceshion subscriptions and credit packs are processed by Lemon Squeezy (Lemon Squeezy, LLC), which acts as the Merchant of Record for your purchase. This means Lemon Squeezy handles the transaction, issues the invoice, and is responsible for collecting and remitting any applicable sales tax, VAT, or GST. Your purchase is also subject to Lemon Squeezy’s Terms of Service and Privacy Policy.

4b. Digital Delivery (Instant Access)

Faceshion is a fully automated digital service. Immediately upon successful payment, your account is credited with the purchased try-on credits and/or subscription entitlements, and the Service becomes accessible from your merchant dashboard. There is no manual fulfillment, shipping, or post-purchase service work required from us to deliver the product — everything is “download / use ready” the moment the transaction is approved.

Test purchases: If you wish to test the checkout flow, please use the test-mode payment links provided in your merchant dashboard. Do not use a real card to test a purchase, as repeated real-card test transactions may be flagged by payment processors as suspicious activity.

5. Refunds & Cancellations

You may request a refund within 14 days of purchase if fewer than 10% of your plan credits have been used. Custom Enterprise contracts are governed by their own agreement. To request a refund, contact faceshionapp@gmail.com. For the full policy, see our Refund & Cancellation Policy.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or to violate any third-party rights.
Upload non-consensual imagery of any person.
Reverse-engineer, scrape, or attempt to extract the underlying AI models.
Resell, sublicense, or rebrand the Service without our written permission.
Use the Service to generate misleading, defamatory, or sexually explicit content.

7. Intellectual Property

All software, models, designs, logos, and content provided by Faceshion are owned by us or our licensors and are protected by intellectual property laws. You retain ownership of content you upload, but grant us a worldwide, non-exclusive license to process it solely for the purpose of providing the Service.

8. Merchant Responsibilities

Merchants are responsible for: (a) ensuring they have the legal right to display the product images submitted to the Service; (b) disclosing the use of AI virtual try-on and any image processing in their own privacy policy; (c) complying with applicable consumer-protection laws including GDPR, CCPA, and local equivalents.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. AI-generated try-on previews are visual approximations and do not guarantee an exact fit, color, or appearance.

10. Limitation of Liability

To the maximum extent permitted by law, Faceshion will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access if you breach these terms. You may cancel your account at any time from the merchant panel. Sections that by their nature should survive termination (e.g., IP, liability, governing law) will continue to apply.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice at least 14 days before they take effect.

13. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Disputes shall be resolved in the competent courts of Istanbul, unless mandatory consumer-protection laws of your jurisdiction apply.
